The article is devoted to the legal status of the proprietary institutions. The article deals with the legal personality of institutions in general and state and public institutions MES of Russia in particular. The article examines these legal categories, the concept institution personality, authority and capacity of institutions, and considers the establishment of a legal entity noncommercial. The theoretical analysis. Expressed the position that the Russian Emergency Situations Ministry agencies have special legal capacity and financial and legal status.
