Currently, in all types of legal proceedings in the Russian Federation, such a means of proof as an opinion on the results of an expertise prepared by a private expert is actively used. At the same time, being a qualified specialist in his field, a private expert does not always have sufficient procedural knowledge, which leads to a violation of the requirements of procedural law and, as a result, entails the recognition of expert conclusions as inadmissible evidence in the case. The solution to the problem is possible by unifying the certification procedure for private experts and including in this unified procedure for testing the knowledge of the applicant for the status of a private expert of the basics of procedural law related to the appointment and conduct of a forensic expertise.
