The article covers questions of restriction of the rights and freedoms of the person and the citizen while putting into operation of the special regime in historical and legal aspect and in the modern Russia. Attention is paid to features of the special regimes entered in ancient Rome during the time of social-political strife in the first half of the XIX century, in Spain and in the pre-revolutionary Russia.
