The article deals with the problems associated with the restriction and protection of human and civil rights and freedoms in an emergency situation. These issues are considered through the prism of the state's obligation to recognize, respect and protect the rights and freedoms of people and citizens. The analysis of the norms contained in articles 55 and 56 of the Constitution of the Russian Federation is carried out, the opinion is expressed about the need for public control over the actions of the head of state in the event of restrictions of rights and freedoms in a state of emergency. Based on the analysis, the authors of the article formulated specific proposals for amendments to the current Russian legislation.
