Based on the constitutional guarantee of the state to protect the rights and freedoms of man and citizen, the article considers an array of normative legal acts that determine the legal status of a professional rescuer, that is, a citizen of the Russian Federation who acquired the status of a rescuer in accordance with the procedure established by law and carries out activities on a (regular) basis in professional emergency rescue services or formations. As a result of the conducted research, the definition of a firefighter who is a rescuer in an emergency situation related to fires has been formulated for legislative consolidation. It is concluded that it is inappropriate to divide rescuers, including firefighters, into workers and specialists. According to the authors, it is necessary to classify all rescuers into one category of workers – specialists. To solve this problem, a proposal has been prepared to amend the Federal law «On emergency rescue services and the status of rescuers».
