The article is devoted to a comparative analysis of the norms of penal enforcement legislation and departmental normative legal acts regulating the legal grounds for recognizing a convicted person as a malicious violator of the regime of serving his sentence. The relevance of the issue under consideration is justified by the need for effective application of the progressive system of execution of punishment in Russia, one of the elements of which is to change the conditions of serving sentences of convicts depending on their behavior, and in particular, to transfer malicious violators of the regime to strict conditions of serving their sentences. The author points out a number of significant shortcomings in the regulatory regulation of this area of penal relations. A systematic adjustment of certain norms of regulatory documents regulating, among other things, the organization of preventive work in places of deprivation of liberty is proposed. The main conclusion is a proposal to adjust the list of serious violations of the established procedure for serving sentences, as set out in article 116 of the Penal enforcement code of the Russian Federation, with subsequent changes in the provisions of regulatory legal acts on the execution of sentences.
