The authors carried out a comparative analysis between the public institutions of the old design, the new type of budgetary institutions and state agencies. Identified positive aspects of reform and gaps in the legislation. Proposed by-law to regulate the level of disposal of real estate agencies, the procedure for calculating prices of services (works), and a list of services (works) that may provide institutions the Russian Emergencies Ministry, to approve the model provisions (statutes) for public institutions a certain type of Russian Ministry of Emergency Situations. Comment on the failure of the founder of vicarious liability for the debts of the institution.
